Romania: Schoenherr helps Electrica win EUR 46m administrative contentious litigation

Schoenherr Romania successfully assisted Societatea Energetica Electrica (Electrica) in winning a long-term administrative contentious litigation case, with a stake worth EUR 46m. Electrica filed this case seven years ago against the Romanian Court of Accounts, a state authority charged with conducting financial audits of the management of state and public resources, with a view to obtaining the annulment of an administrative decision by the authority claiming that Electrica had misused company funds.

Serbia: Diving into the CBAM Regulation: how does it function alongside the EU ETS?

As noted in our previous article on this topic, the CBAM is a new carbon tariff instrument introduced as part of the EU's Fit for 55 package, a strategy to reduce the EU's greenhouse gas emissions by at least 55 % by 2030. The CBAM applies to imports into the EU of certain products and is based on the emissions generated in their production outside of the EU. Currently, in the transitional phase of the CBAM, importers only have the obligation to report on the amount of emissions embedded in the products they import, but from 2026 onwards they will also be obliged to buy and surrender CBAM certificates to cover for these emissions. Therefore, under the CBAM, non-EU producers will not only have to assist their EU partners in the reporting process, but also potentially face significant impacts on their businesses as a result of the new financial burdens importers will encounter.

Of trademarks, designs and other IP rights

When developing or refining a product, including its branding, a lot of time and money are invested in creating something unique that customers will need and love. To protect this financial and creative investment, legislators have decided to grant certain monopoly rights or intellectual property (IP) rights. So, how do you determine the appropriate type of protection for your product? In our blog (link) we have mainly discussed trademark protection. But trademark law is broader than you might expect. Besides the "name" of a product, other features such as the shape, the colouring or a sound can be protected as long as they are recognised as an indication of origin and no absolute ground for refusal, like the technical functionality of the feature, applies. Still, trademark law "merely" protects indications of origin. Fortunately, there are also other IP rights that should be considered as part of a protection strategy.
